NOTICE OF SALE 2017-CP-16-00076 BY VIRTUE of a decree heretofore granted in the case of: Wilmington Savings Fund Society, FSB, as trustee of Stanwich Mortgage Loan Trust A against Vanessa Howle, I, the undersigned Special Referee for Darlington County, will sell on July 1, 2019, at 12:00 p.m. at the Darlington County Courthouse in Darlington, South Carolina, to the highest bidder, the following described property, to-wit: All that certain piece, parcel, or lot of land, with all improvements thereon, situate, lying, and being in Darlington County, South Carolina, fronting seventy-six (76) feet on Stanley Circle and being bounded according to a plat made by J.E. Tucker, Jr., Registered Surveyor, dated February 9, 1983, as follows: On the North by said Stanley Circle; on the East by land of Wayne Anderson for a distance of one hundred ninety-seven and five-tenths (197.5) feet; on the South by land of Cora S. Griggs for a distance of one hundred thirty-four (134) feet; and on the West by a ditch for a distance of two hundred eight (208) feet. For a more particular description reference is hereby made to plat above referred to, a copy of which is filed in the Office of the Clerk of Court for Darlington County in Plat Book 92, at page 171. Together with all and singular the rights, members, hereditaments and appurtenances to the said premises belonging, or in any way incident or appertaining. Being the same property conveyed to Jennings H. Howle, Jr. by deed of Louise H. Anderson, dated March 8, 1983 and recorded March 15, 1983 in Deed Book 849 at Page 926; thereafter, Jennings Heyward Howle, Jr. died testate on April 27, 2011, leaving the subject property to his devisee, namely, Vanessa Howle, by Deed of Distribution dated September 19, 2015, and recorded October 15, 2015 in Deed Book 1076 at Page 8194. TMS No. 165-00-01-008 Property Address: 563 Stanley Circle, Darlington, SC 29532 TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, five per cent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff's debt in the case of noncompliance. Should the successful bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions as set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the Deed and interest on the balance of the bid from the date of sale to the date of compliance with the bid at the rate of 10.5300%.
