SPECIAL REFEREE'S NOTICE OF SALE BY VIRTUE of a decree heretofore granted in the case of Grand Coast Capital Fund I, LLC v. Summit Terminal, LLC, et al. (Civil Action No.: 2018-CP-33-670), I, the undersigned, Special Referee for Marion County have ordered that the following property, which is the subject of the above action, be sold on Monday, July 29, 2019 at 11:00 a.m., by the Special Referee at the Marion County Courthouse, 100 West Court Street, Marion, South Carolina to the highest bidder: TRACT NO. 1 containing 14.377 acres and being bounded generally on the North by lands of Pee Dee Electric Cooperative, Inc., on the East by the right-of-way of S-34-75 and a County road extending generally southwesterly there from, on the South by lands of Pee Dee Electric Cooperative, Inc., and on the West by the run of Catfish Swamp separating Tract No. 1 from lands of International Paper Company. TRACT NO. 2 containing 0.745 acres, being triangular in shape and being bounded generally on the Northeast by Sara Lee Corporation, on the Southeast by lands of Atkinson, and on the Southwest by a road separating Tract No. 2 from lands of Atkinson, and on the Southwest by a road separating Tract No. 2 from lands of Pee Dee Electric Cooperative, Inc. Also, all that certain tract of land situate near the City of Marion, County of Marion, State of South Carolina, containing twenty-four and 93/100 acres, bounded Northeast by US Highway 76-501 By-Pass and land of E.J. Atkinson, southeast by land of D.M. Wiggins and E.J. Wiggins and land of E.J. Atkinson, Southwest and Northwest by land of Waddell Byrd and being more particularly bounded and described on map of property surveyed for Marion County, Waddell Byrd Tract, Marion County, S.C., by Johnson Engineers, dated April 1970, to which reference may be had. This being the same property conveyed to Summit Terminal, LLC by deed of Apex Realty, Inc., recorded in the Office of the Register of Deeds for Marion County on December 12, 2017 in Book 399 at Page 219. TMS No. 075-00-00-188-000 Property Address: 520 SC Highway 576, Marion SUBJECT TO ASSESSMENTS, MARION COUNTY TAXES, EXISTING EASEMENT AND RESTRICTIONS OF RECORD AND OTHER SENIOR ENCUMBRANCES. TERMS OF SALE. The successful bidder, other than the plaintiff, will deposit with the Special Referee at conclusion of the bidding, 5% of his bid, in cash or equivalent, as evidenced in good faith, said to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff's debt in case of non-compliance. Should the last and highest bidder refuse to make the required deposit at time of bid or comply with other terms of the bids within twenty (20) days, when the Special Referee may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). Personal deficiency being demanded the bidding will remain open for thirty (30) days, but compliance with the bid may be made immediately. Plaintiff may waive any of its rights prior to sale. In the event an agent of the plaintiff does not appear at the time of the sale, the within property shall be withdrawn from sale and sold at the next available sales day upon the terms and conditions as set forth in the Decree of Foreclosure and supplemental order. Plaintiff to pay for documentary stamps on Deed, if applicable. The successful bidder will be required to pay interest in the amount of the bid from the date of sale to the date of compliance with the bid at the rate of 18.00% as to Note A and as to Note B.
